Terms & Conditions

These terms govern your use of devlumina.in and any purchase you make from us. By using this website you accept them. If you do not accept them, please do not use the website.

1. Who you are contracting with

Dev Lumina is a sole proprietorship registered in Chhattisgarh, India, whose proprietor is Nirmala. It is registered as a micro enterprise under Udyam Registration Number UDYAM-CG-06-0039284.

2. Eligibility

You must be at least eighteen years old and capable of entering into a contract under the Indian Contract Act, 1872 to buy from us. By placing an order you confirm that you are.

3. Products, description and variation

Our candles are hand-poured into hand-finished terracotta vessels. They are not machine-made and they are not identical. Variation in the colour of the fired clay, the exact placement and weight of surface motifs, small surface marks, and minor differences in the finish of the wax are inherent to the product and are not defects.

Photographs and descriptions on the website are indicative. Screen colour reproduction varies. Fragrance is subjective and its perceived strength depends on room size, ventilation and temperature.

The surface motifs on our vessels are our own drawings, made in the spirit of the folk and tribal linear geometry found across Chhattisgarh. They are not reproductions of any particular community's artwork, and we make no claim of tribal authorship or of any geographical indication.

4. Orders

Your order is an offer to buy. A contract is formed only when we send you an order confirmation. Until then we may decline or cancel an order, including where:

  • the item is out of stock or a batch has failed quality checks;
  • the price or description was listed in error;
  • we cannot deliver to the address given;
  • we suspect fraud or misuse.

If we cancel an order you have already paid for, we refund it in full. See the Refund & Cancellation Policy.

5. Pricing, taxes and payment

  • All prices are in Indian Rupees (INR).
  • Prices will be inclusive of applicable GST unless stated otherwise at checkout, and an invoice is issued for every order.
  • Shipping charges, where applicable, are shown before you pay. See the Shipping Policy.
  • We may change prices at any time. The price that applies to your order is the one displayed when you place it.
  • Payments will be processed by a third-party payment gateway. We do not receive or store your card, UPI or bank credentials.

6. Bulk and corporate orders

Bulk, corporate and customised orders are governed by the written quotation and any purchase order or agreement we sign with you, which take precedence over these terms where they conflict. Customised orders, including custom scent, custom motif, custom packaging or printed seed paper, generally require payment in advance, have longer lead times, and once production has begun cannot be cancelled or returned except for defects.

Minimum order quantities, price bands and lead times are being finalised with our first production run and will be quoted in writing for each enquiry.

7. Safe use of candles

Candles are an open flame. You are responsible for using them safely. Follow the instructions supplied with the product and, at minimum:

  • Never leave a burning candle unattended, and keep it away from children and animals.
  • Burn on a heat-resistant, level, stable surface. A terracotta vessel gets hot; it can mark or damage the surface underneath.
  • Keep away from curtains, paper, and anything else that catches fire.
  • Trim the wick to about 5 mm before each burn.
  • Do not burn for more than four hours at a time.
  • Stop burning when roughly 10 mm of wax remains.
  • Do not move a candle while it is lit or while the wax is molten.
  • Do not use the vessel for food after it has held wax.

To the extent permitted by law, we are not liable for damage or injury caused by use that departs from these instructions.

8. Intellectual property

The Dev Lumina name and logo, this website's copy, photographs, artwork and our product designs are our property and are protected by Indian law. An application to register the Dev Lumina trade mark has been filed with the Trade Marks Registry and is pending; the mark is not yet registered. You may not copy, reproduce or use any of it commercially without our written consent. Nothing on this website asserts any right over traditional craft forms, which belong to the communities that practise them.

9. Acceptable use

You agree not to:

  • use the website for any unlawful purpose;
  • submit false, abusive or automated form submissions;
  • attempt to gain unauthorised access to the website or its systems;
  • scrape, mirror or resell the content of this website.

10. Third-party links and services

This website may link to third-party services, including our payment gateway, courier partners and marketplace listings. We do not control them and are not responsible for their content, policies or practices.

11. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or in connection with an order is limited to the amount you paid for that order. We are not liable for indirect or consequential loss, including loss of profit, business or goodwill. Nothing in these terms excludes liability that cannot be excluded by law, including under the Consumer Protection Act, 2019.

12. Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural events, fire, flood, epidemic, government action, strikes, courier failure, power failure and network outages.

13. Governing law and jurisdiction

These terms are governed by the laws of India. Subject to the rights of a consumer under the Consumer Protection Act, 2019 to approach the appropriate consumer forum, the courts at Janjgir-Champa, Chhattisgarh have exclusive jurisdiction over any dispute arising out of these terms.

14. Grievances

Complaints go to hello@devlumina.in. We acknowledge within forty-eight hours and aim to resolve within thirty days. The details of our grievance officer are published in the Privacy Policy.

15. Changes to these terms

We may update these terms. The version in force for your order is the version published when you placed it. Changes are dated at the top of this page.
